Copyright - It's meant to protect the works of creators and authors from unauthorized producing and sharing of their work, it is an exclusive, however temporary, right to their work. Its meant to promote the progress of works and support creativity in society. Under this law, protection attaches the moment the work is created, it lasts for the life of the author, plus 70 years.

Generally,  it protects works of authorship which are fixed in a tangible means of expression. Copyright would apply to a written work, but copyright could also apply to a musical piece, a sculpture, etc. The key is the work is part of a fixed format. Ideas alone cannot be copyrighted.

Gain the Protections

  • A work of authorship or a creation work
  • Needs to be original
  • In a fixed format
  • Once all are applied copyright protections will go into place + Your work does not have to be published to have copyright.

Under Title 17 of the United States Code, authors and creators have rights to production of their work

Fair Use - Under this, someone who is not the copyrighted author is allowed to use their work under certain conditions:

  • Cites work in criticism 
  • Uses to teach in a class
  • Makes some type of transformation to the work, among other.

Towards a More Modern Conception

  • DMCA's (Digital Millennium Copyright Act) created in 1998 was the first step
  • The desired scope of internet and copyright protections, in some sense, are contrary to each other
  • Yet enhanced copyright protection in some online spheres is needed
  • Potential solutions: Shorter protection times, watermarking, footers denoting authorship, among other possibilities
